Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Gridrive, Inc. ("Gridrive," "we," "us," or "our") and govern your use of the Mozin mobile application and the gomozin.com website (together, the "Service"). Please read them carefully.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who can use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to accept these Terms on its behalf, and "you" includes that business.
Your account
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us promptly at hi@gomozin.com if you suspect unauthorized use. You are responsible for the accuracy of the information you provide.
Your content and your customers' data
You keep all rights to the data you put into the Service — your customers, jobs, notes, and invoices ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service for you.
You are responsible for Your Content and for having the rights and permissions needed to store and process it, including the personal information of your customers. As between you and us, you are the controller of your customers' personal information, and you agree to handle it in compliance with the laws that apply to your business.
Text message (SMS) reminders
The Service includes an optional feature that sends SMS appointment reminders to your customers. Text reminders are sent only to customers who have opted in themselves through Mozin's secure opt-in page: you share a personal opt-in link with your customer (by email from the app, or by copying the link), and the customer confirms their phone number and agrees to receive reminders. You represent and warrant that you share opt-in links only with your own current customers with whom you have an existing service relationship, that you will not complete or attempt to complete the opt-in on a customer's behalf, and that you will comply with all applicable laws and rules, including the U.S. Telephone Consumer Protection Act (TCPA) and carrier and industry messaging requirements. If a customer asks you to stop text reminders — by any reasonable means, including in person, by phone, or by email — you agree to promptly mark them as opted out in the app. Mozin records each customer's consent and provides the delivery mechanism.
Reminders are transactional messages about upcoming appointments — typically one to two per appointment — and always include opt-out instructions. Your customers can reply STOP to unsubscribe at any time, or HELP for assistance; we honor those requests and stop sending to numbers that opt out. Message and data rates may apply to recipients, and mobile carriers are not liable for delayed or undelivered messages.
You agree not to use the SMS feature to send marketing, promotional, or any non-reminder content, or to message customers who have not consented or who have opted out. We may suspend or disable SMS sending for your account if we believe it is being used in violation of these Terms or of messaging rules.
Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- upload content that infringes others' rights or violates any law;
- attempt to access accounts or data that are not yours, or probe, scan, or breach our security;
- interfere with or disrupt the integrity or performance of the Service; or
- reverse engineer, copy, or resell the Service except as permitted by law.
Subscriptions and payments
Mozin offers a free tier and may offer paid plans with additional features. If and when you buy a paid subscription, the price and billing terms will be shown to you before you confirm. Paid subscriptions purchased through the Apple App Store or Google Play are billed and managed by those stores under their terms, including their rules for renewals, cancellations, and refunds. Unless a refund is required by law or store policy, payments are non-refundable.
When your customers pay an invoice online, a per-payment processing fee applies (Stripe's card fee plus a flat Mozin fee). This fee is deducted at the time of payment. If you later refund a customer, the per-payment Mozin fee is not returned — it covers having processed the original payment, which already occurred.
Custom domains
If you buy the website add-on and choose to purchase a custom domain (for example, yourbusiness.com) through Mozin, we register that domain on your behalf using Gridrive's information as the domain's registrant of record with the domain registry, instead of yours. We do this so that you never receive, and can never miss, the domain-ownership verification email that registrars are required to send, which can suspend a domain — and take your website offline — if it is ignored. The domain remains yours to use for as long as your Mozin subscription and domain payments are active, and we will transfer it into your own name and control at any time you request, using the standard domain-transfer process.
The domain is billed separately from your subscription, once a year, and renews automatically unless you cancel it. If you stop paying for the domain, it will stop renewing and will eventually expire, taking your website offline; we will email you advance warnings before that happens. If you cancel the website add-on but keep paying for the domain, your website is taken offline but the domain itself stays registered and continues to renew normally.
App store terms
You download the Mozin app through the Apple App Store or Google Play, and your use is also subject to those stores' terms. With respect to the Apple App Store, you acknowledge that these Terms are between you and Gridrive only — not Apple — that Apple has no obligation to provide support for the app, and that Apple is a third-party beneficiary of these Terms with the right to enforce them.
Intellectual property
The Service, including the Mozin name, logo, software, and design, is owned by Gridrive and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding. We welcome your feedback and may use it without any obligation to you.
Third-party services
The Service relies on and can connect to third-party services (for example, your device's email or messaging apps to send invoices). We are not responsible for third-party services, and your use of them is governed by their own terms.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Mozin is a tool to help you run your business; it is not a substitute for professional accounting, tax, or legal advice.
Limitation of liability
To the maximum extent permitted by law, Gridrive and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.
Indemnification
You agree to indemnify and hold harmless Gridrive from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. The provisions that by their nature should survive termination — such as ownership, disclaimers, limitation of liability, and indemnification — will survive.
Changes to the Service and these Terms
We may change or discontinue features of the Service, and we may update these Terms from time to time. When we make material changes to the Terms, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute that is not subject to small-claims court, and you consent to venue there.
